I. General terms and conditions
1. Applicability of the terms
These general terms and conditions apply to all contracts concluded with the aforementioned hotel. They may be replaced by conditions negotiated in individual cases. Conflicting terms and conditions of Vertragspartnernwerden do not take effect, even if you enter the Kotel after the contractual partner has received these GT

2. Conclusion of the guest reception agreement
The valid price list with the respective tariffs and service descriptions is decisive. Furthermore, services and tariffs are subject to alteration. The guest reception contract (accommodation contract) can be made in writing, orally, by telephone, by fax, by e-mail or by conclusive conduct. The conclusion of the host agreement obliges both contract partners to fulfil the contract, irrespective of the duration of the contract. In the case of Hotel nights, the guest reception contract is concluded as soon as the room has been ordered and promised or, if due to time constraints, a commitment was not possible.

3. Reservations
If rooms or other services (e.g. food) are reserved on an option basis, the option data for both contract partners is binding. At the end of the agreed option period, the aforementioned hotel may freely dispose of the rooms and services booked in option. Reserved rooms and confirmed by the hotel are provided on the day of arrival from 14.00 pm and on the day of departure until 10.30 p.m. The hotel is entitled to award reserved rooms on the day of arrival after 18.00 p.m. unless a later arrival time has been expressly agreed upon.

4. Price Changes
Agreed prices can be changed after conclusion of the contract by the hotel according to the then valid price lists, if the Zeitraurn between the conclusion of the contract and the provision of the individual service is more than 4 months.

5. Terms of payment
Die Rechnungen sind, soweit nicht ausdrücklich andere Zahlungsbedingungen vereinbart sind, mit Zugang der Rechnung sofort ohne jeden Abzug und in bar zur Zahlung fällig. Die Akzeptierung und die Auswahl von Kreditkarten ist dem Hotel in jedem einzelnen Fall der Vorlage einer Kreditkarte freigestellt und zwar auch dann, wenn die grundsätzliche Akzeptanz von Kreditkarten durch Aushänge im Hotel angezeigt wird. Die Entgegennahme von Schecks, Reiseschecks, Kreditkarten und sonstigen Zahlungsmittein erfolgt im Übrigen nur erfüllungshalber.

Zahlungsverzug mit auch nur einer Rechnung berechtigt das Hotel alle weiteren und zukünftigen Leistungen für den Gast einzustellen. Voraussetzung ist, daß das Hotel die Inverzugsetzung durch eine Mahnung unter Fristsetzung und Hinweis auf diese Folgen bewirkt. Übersteigt der Rechnungsbetrag 200 € oder hält sich der Gast länger als 6 Tage im Hotel auf, so ist das Hotel berechtigt, jeweils einzelne Zwischenrechnungen zu stellen und deren Bezahlung vom Gast zu verlangen.

6. Advance Payments
The hotel is entitled by a guest who has not pre-reserved to demand advance payments in the amount of an overnight stay at the conclusion of the host contract. The hotel may, without justification, make any Bestellannahrne, reservation or other service, which is to be carried out or to be continued, dependent on the total or partial payment of the amounts likely to be owed in advance, in the form of Advance payments or total prepayments.

7. Cancellations, cancellation conditions
If a guest cancels the order/reservation of an apartment, meal or other service offered by the hotel, the hotel will charge a cancellation fee of 80% of the price if the cancellation is not at least 48 hours before the due date of the respective performance. The cancellation fee increases to 100% if the guest cancels on the due date. It is reduced by the amounts that the hotel collects by renting the apartment in other ways or by administering the meal or providing other services to a third party. In the case of partial cancellation, the cancellation fee is calculated proportionately.

8. Liability
§ § 701-703 of the German Civil Code applies to the liability of the hotel. Liability for other reasons is excluded, unless a damage was caused intentionally or negligently by the hotel, its legal representatives or vicarious agents, or in the case of bodily damage.

9. Other provisions
a) In den öffentlichen Bereichen des Hotels ist das Verzehren von mitgebrachten Speisen und Getränken untersagt. Bei Verstößen ist das Hotel berechtigt, von dem Gast eine Pauschale in Höhe von 75 % des Preises für eine von ihm angebotene vergleichbare Speise bzw. ein von ihm angebotenes vergleichbares Getränk zu verlangen. Ebenfalls untersagt ist die Bestellung von Speisen bei einem anderen Restaurant, Pizza-Service und ähnlichem Anbieter zur Lieferung in das Hotel und Verzehr im Appartment. Bei Verstößen ist das Hotel berechtigt, eine Pauschale von 5,00 € pro Speise zu erheben.
b) Die Überschriften dienen nur der besseren Übersicht und haben keine materielle Bedeutung, insbes. nicht die einer abschließenden Regelung.
c) Für diese Bedingungen und die gesamten Rechtsbeziehungen zwischen dem Hotel und dem Gast gilt das Recht der Bundesrepublik Deutschland.
d) Gerichtsstand ist das für Lindberg zuständige Amts- bzw. Landgericht

10. Withdrawal of reservations

II. Special terms and conditions for GRUPPEN1. For groups the above general terms and conditions apply with the following deviations and additions.

2. Reservations
Every reservation is only effective and guaranteed on the basis of written confirmation from the hotel. The effectiveness of each reservation for groups depends on the payment of a deposit equal to 50% of the services to be reserved, the deposit must be received 20 days before the arrival of the group at the hotel, so that the reservation effective.

3. Additional Services
The costs incurred in addition to the agreed contractual services such as telephone, bar etc. are to be paid by each group participant before departure. If this does not happen, the group organizer is jointly and severally liable.

4. Liability
The group organizer is liable for damage or loss of facilities or inventory caused by the group participants during the stay, without proof of fault. Fire and commercial police regulations must be observed. The hotel is only liable for damage or loss of other items brought in or in the parking lot of the hotel in case of intent or gross negligence. In addition, § § 701-703 BGB shall apply accordingly.

5. Number of participants
The number of participants indicated by the group organizer at the reservation is binding for both parties. If the organiser can only indicate the number of participants, deviations up to 10% are possible downwards compared to the indicated number, but in this case the exact number of participants must be notified no later than 30 days before arrival. A concrete list of names of the participants is to be transmitted to the hotel no later than 14 days before arrival.

6. Gem
All music events must be reported and if necessary by the organizer in advance. Also be cancelled again. The fees of gema shall be borne by the organizer. The hotel is exempt from the organizer regarding any claims of GEMA, which arose from unauthorized use of the rights of GEMA or third parties (e.g. for non-registration by the organiser).

7. Cancellations, cancellation fees
Bei Stornierungen berechnet das Hotel folgende Stornogebühren:
– Bei Stornierungen zwischen dem 60. und 21. Tag (jeweils einschließlich) vor Erbringung der bestellten/reservierten Leistung: 40 % des Preises
– Bei Stornierung zwischen dem 21. und dem 8. Tag (jeweils einschließllich) vor Erbringung der bestellten/reservierten Leistungen: 60% des Preises
– Bei Stornierung zwischen dem 7. und dem 3. Tag (jeweils einschließllich) vor Erbringung der bestellten/reservierten Leistungen: 80% des Preises
– Bei Stornierung innerhalb von 48 Stunden vor Erbringung der bestellten/ reservierten Leistungen: 100% des Preises
Wegen der Teil-Stornierung und der möglichen Minderung der Stornogebühr wird auf Teil I Nr. 7 Sätze 3 und 4 verwiesen.
